ODP Suspended Following Review of Conditions of Practice Order

Operating department practitioner Jolene Khumalo has been suspended from the HCPC Register following a review of a 2013 conditions of practice order resulting from lack of competence.

A panel of the HCPC Conduct and Competence Committee conducted a substantive review of Mrs Khumalo’s conditions of practice order first imposed on 1 May 2013. The order was originally imposed whilst Mrs Khumalo was employed at the Royal Orthopaedic Hospital NHS Foundation Trust’s Birmingham site, after a number of deficiencies in her performance were identified.

In the absence of any evidence that Mrs Khumalo has addressed the deficiencies in her practise identified at the final hearing, the Panel concluded that her fitness to practise remains impaired. In an email to the HCPC sent on 9 April 2015, Mrs Khumalo indicated that she was currently on a full-time study programme in a bid to change profession.

Panel Chair Sheleen McCormack commented:

“Given Mrs Khumalo’s stated intention not to return to practise as an ODP, an order of conditions would not be relevant. The Panel has therefore determined that it is proportionate, appropriate and in the public interest to impose an order of suspension. This order will give her adequate time to reflect and a further opportunity during that period should she seek an early review to show that she wishes to continue her practise.”

The Panel decided the most proportionate and appropriate sanction was to suspend Jolene Khumalo from the Register for a period of 12 months.

Jolene Khumalo was not present or represented at the hearing.
