NHS England: Nursing Agency Rules

New rules on nursing agency spend from Monitor and the NHS Trust Development Authority for NHS foundation trusts and NHS trusts.

 

The new rules came into effect on 1 September 2015 and apply to agency spend on registered nursing, midwifery and health visiting staff only; rules on other agency staff will follow shortly.

Who should follow these rules:

  • all NHS trusts
  • NHS foundation trusts receiving interim support from the Department of Health
  • NHS foundation trusts in breach of their licence for financial reasons

All other NHS foundation trusts are strongly encouraged to comply. Due to staffing mix, the spend ceiling will not apply to ambulance trusts. However, all other rules will apply to ambulance trusts.

The rules are part of a national programme of work to assist NHS foundation trusts and NHS trusts to meet the complex workforce challenges facing the sector and to help improve patient safety. This guidance follows the engagement period  in August 2015 when we invited comment on our initial proposals.
